Is chapter 13 worth it?

Some of my clients inform me that the repayment options of a chapter 13 bankruptcy do not really seem worth it.  There is a prevailing opinion that they are not left with enough money to live on or it will be difficult to make these payments for three to five years.  What I tell them is they do not have to file.  However, as much as they may have to cut back on expenses in a chapter 13, they would probably be more strapped if their creditors got judgments against them in court.

A creditor can seek to garnish wages of lien property.  Those judgments against you can wipe out any money you may have had saved in the bank and put you in a worse position than bankruptcy.  The purpose of a chapter 13 bankruptcy is to repay the creditors you can, and then, start fresh without any of the debts hanging over you at the end of three to five years.  Depending on your situation a chapter 13 filing is definitely worth the hassle.  It can get your life back on track and help you overcome some of those financials hurdles that are standing before you.
